Former President of Brazil da Silva remains in custody

Carlos Eduardo Thompson Flores, Chairman of the Federal regional court of the fourth district of Brazil, decided to leave under arrest the former President of the country  Luiz Inacio Lula da Silva.

In Brazil, three judges had to be involved in the release of the former head of state. Da Silva was in custody for 90 days in the Federal police of Curitiba, after he was convicted of corruption for 12 years and one month in prison, according to the Khmer Times.

However, his colleagues on the left of the workers ‘ Party (PT) filed a notice of appeal with a request to release da Silva before his case will be considered in all instances, including the highest – the Federal Supreme court. Judge rojerio Favretu agreed with the arguments presented in the appeal and ordered the release of the former President.

However, the judge of first instance Sergio Moro, who initially considered the case of the former President, appealed to higher authorities in order to cancel the decision to release the politician. In his opinion, judge Favreau, being the duty of the judge of the Federal regional court, no right to free Lula da Silva in spite of the decision of the Federal regional court of the fourth circuit and the Supreme Federal court of Brazil.

The issue was resolved by the Chairman of the Federal district court for the Thompson Flores: he has left under arrest of da Silva.

Recall, Lula da Silva was brought to trial in 2016. A year later, he was sentenced to 12 years in prison. However, using the right of appeal, Lula da Silva remained free until April 2018. Then the Supreme court rejected his request to abolish the sentence and detained him. He was found guilty of receiving an apartment from the OAS construction company as part of a corruption scheme related to the state oil and gas giant Petrobras. Moreover, the former President is accused of six more trials.
