\u201cEveryone seems to know (or hope) that the present administration is an exception.\u201d<\/strong><\/p>\n

Jessica Tillipman<\/a> was<\/span>\u00a0recently leading an anti-\u00adcorruption training in Washington, DC, to a roomful of visiting bureaucrats from Latin America<\/a> when something odd happened. As she described various measures the United States<\/a> has in place to guard against self-dealing and conflicts of interest by government officials, she heard snickering.<\/strong><\/p>\n

In the past, she recalls, foreign guests \u201cwould look on kind of in awe\u201d as she described the federal government\u2019s elaborate system for preventing graft and corruption. That has all changed since the election of Donald Trump<\/a>. Now, her international colleagues are quick to point out that the United States can\u2019t even get its own president to abide by the nation\u2019s ethical standards. \u201cIt was almost a bit of a joke,\u201d\u00a0Tillipman<\/a>, an expert on government ethics and an assistant dean at the George Washing\u00adton University Law School<\/a>, says of the recent training. \u201cTo have countries with their own distinct corruption issues laughing at our current issues\u2014it\u2019s embarrassing.\u201d<\/p>\n

For decades, the United States has held itself up as a pillar of open and ethical government. On many fronts, it has led by example, enacting and enforcing some of the world\u2019s toughest anti-\u00adcorruption and ethics statutes. It has used its reputation and economic clout to prod other countries to clean up their acts, encouraging them to pass anti-bribery and transparency laws and spending millions of dollars training foreign officials in the ways of good governance\u2014efforts that amounted to a type of soft power, smoothing over trade relations and bolstering diplomatic ties. And investors like the predictability of open government and honest business dealings. Yet interviews with more than a dozen experts show that the United States is rapidly tarnishing its squeaky-clean image.<\/p>\n

\u201cIt\u2019s hard to put lipstick on the pig: There\u2019s a very, very different perceived reputation now than three or four months ago,\u201d says\u00a0Nathaniel Heller<\/a>, who helps oversee the\u00a0Open Government Partnership<\/a>, an anti-\u00adcorruption organization founded in 2011 at the Obama administration\u2019s urging. \u201cIt\u2019s particularly acute because of the very real conflicts of interest and entanglements that the [Trump] family and administration seem to be deeply uninterested in trying to untangle.\u201d<\/p>\n

Even before he fired FBI Director<\/a> James Comey<\/a>, Trump had\u00a0openly broken<\/a>\u00a0with the ethical norms and expectations followed by all recent presidents. He refused to divest from his international real estate and licensing company. (In contrast, Barack Obama<\/a>\u00a0declined to refinance his home mortgage<\/a>\u00a0and Jimmy Carter<\/a>\u00a0sold his peanut farm<\/a>\u00a0out of concern that they might be accused of having a conflict of interest.) Trump\u2019s daughter Ivanka<\/a> and his son-in-law, Jared Kushner<\/a>\u2014who also\u00a0haven\u2019t fully divested<\/a> from their real estate and investment holdings\u2014were appointed as top White House aides to the president. The National Security Council<\/a> (NSC) eliminated its directorate for good-\u00adgovernance issues, senior White House<\/a> staffers\u00a0skipped an ethics training course<\/a>\u00a0used by the two previous administrations, and multiple appointees who\u2019d worked as lobbyists were\u00a0granted secret waivers<\/a>\u00a0to serve in the agencies they once lobbied. In July, the top federal ethics watchdog\u00a0resigned.<\/a>\u00a0He explained, \u201cThere isn\u2019t much more I could accomplish at the Office of Government Ethics, given the current situation.\u201d<\/p>\n

Trump\u2019s own actions\u2014and those of his family and close associates\u2014suggest a president seeking to monetize his office. He spends nearly every weekend at a Trump-branded property such as Mar-a-Lago<\/a>, which briefly had its\u00a0own promotional page<\/a>\u00a0on the State Department<\/a> website. Diplomats and industry leaders\u00a0flock to his Washington hotel<\/a>\u00a0in hopes of winning his favor. On the day that Ivanka Trump and her father met with the Chinese president<\/a>, China\u00a0approved<\/a>\u00a0three of her company\u2019s copyright requests. Kushner\u2019s family firm has\u00a0touted<\/a>\u00a0its ability to grab visas for wealthy Chinese investors. \u201cThe stars have all aligned,\u201d Eric Trump<\/a> recently said. \u201cI think our brand is the hottest it has ever been.\u201d<\/p>\n

To make matters worse, Trump and the Republican Congress<\/a> have started\u00a0rolling back<\/a>\u00a0the Obama administration<\/a>\u2019s efforts to combat corruption. In February, Trump\u00a0signed the repeal<\/a>\u00a0of a key provision in the 2010 Dodd-Frank financial reform<\/a> law that had required US oil and gas companies to disclose their payments to foreign governments. This doesn\u2019t look so good when your secretary of state was the CEO of Exxon Mobil<\/a>. The Department of the Interior<\/a> has been\u00a0backing away<\/a>\u00a0from the Extrac\u00adtive Industries Transparency Initia\u00adtive<\/a>, which also publicizes payments to governments by energy companies. The Trump administration has yet to say whether it will remain in the Open Government Partnership<\/a>; if it leaves, the United States will join\u00a0abstainers<\/a>\u00a0such as Russia and Angola<\/a>.<\/p>\n

Trump and the Republican Congress have started rolling back\u00a0Obama\u2019s efforts to combat corruption.<\/div>\n

And there are indications that Trump may try to weaken the\u00a0Foreign Corrupt Practices Act<\/a>, the crown jewel of anti-\u00adcorruption laws. Even before he ran for president, Trump\u00a0expressed hostility<\/a>\u00a0to the FCPA<\/a>\u00a0(Foreign Corrupt Practices Act<\/a>), which prohibits US companies from bribing foreign officials, saying it puts American businesses at a \u201chuge disadvantage\u201d and that it\u2019s a \u201chorrible law and it should be changed.\u201d Part of this animosity may stem from his own experiences trying to take his brand global. A recent\u00a0New Yorker\u00a0<\/em>investigation<\/a>\u00a0found that the Trump Organization<\/a> may have violated the FCPA as part of a failed development deal in Azerbaijan, widely considered one of the world\u2019s most corrupt countries. (A company lawyer dismissed this claim.)<\/p>\n

Trump\u2019s picks to run the two agencies that bring FCPA cases don\u2019t inspire confidence. The head of the Securities and Exchange Commission<\/a>, a corporate lawyer named\u00a0Jay Clayton<\/a>, chaired a New York City Bar Association<\/a> committee that released\u00a0a 2011 paper<\/a>\u00a0that called enforcement of the law \u201cunilateral and zealous\u201d and recommended \u201cthe reevaluation of the United States\u2019 strategy in fighting foreign corruption.\u201d During his confirmation hearings, Attorney General<\/a> Jeff Sessions<\/a>\u00a0pledged<\/a>\u00a0to uphold the FCPA, but some experts fear that weakened enforcement could come in the guise of funding cuts. \u201cI would never question the integrity of the people who are pursuing these cases, but you can cut a budget,\u201d says\u00a0Chris Sanders<\/a>, a spokesman for\u00a0Transparency International<\/a>. \u201cYou can reduce the number of investigators.\u201d<\/p>\n

Convincing officials in corruption-\u00adplagued countries to have the courage to combat graft has always been a tough sell, says\u00a0Shruti Shah<\/a>, a vice president at the Coalition for Integrity<\/a>. Having a president who\u2019s blithely unconcerned about real or perceived corruption only makes it harder. \u201cWe can\u2019t tell people in Africa or anywhere else in the world to do anything we\u2019re not doing ourselves.\u201d The day Trump fired Comey, US Ambassador to Qatar<\/a> Dana Shell Smith<\/a>\u00a0tweeted<\/a>, \u201cIncreasingly difficult to wake up overseas to news from home, knowing I will spend today explaining our democracy and institutions.\u201d\u00a0Mary Beth Goodman<\/a>, an anti-\u00adcorruption official in Obama\u2019s NSC, says that if the United States all but abandons this fight, it could kick off a race to the bottom around the world. \u201cVery little gets done without US leadership.\u201d<\/p>\n

The administration\u2019s actions have sent \u201ca very bad signal\u201d to its inter\u00adnational partners, says Jorge Hage<\/a>, Brazil\u2019s former anti-corruption minister<\/a>. The silver lining: \u201cSooner or later, the US will go back to its traditional policy of promoting and emphasizing public integrity and transparency, and fighting corruption,\u201d he writes in an email. \u201cEveryone seems to know (or hope) that the present administration is an exception, kind of an accident.\u201d<\/p>\n

The Art of the Steal<\/strong><\/h3>\n

Under the\u00a0Foreign Corrupt Practices Act<\/a>\u00a0(FCPA), American companies that operate abroad must screen any potential business partners for hints of corruption or ethical shadiness. President Donald Trump has said the law is\u00a0\u201chorrible.\u201d<\/a>\u00a0Perhaps that\u2019s because if he were a foreign official or businessman, American companies would think twice about working with him.<\/p>\n
