Robert Menendez\u2019s corruption trial"},"content":{"rendered":"<p>This material belongs to: <a href=\"https:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2017\/09\/05\/everything-you-need-to-know-about-sen-bob-menendezs-corruption-trial\/?utm_term=.0456c753df13\">The Washington Post<\/a>.<\/p>\n<p><strong>On Wednesday, a U.S. senator will sit before a jury of his peers and face charges that his friend bribed him to settle disputes for the government.<\/strong><\/p>\n<p><strong>Both Sen. <a href=\"https:\/\/en.wikipedia.org\/wiki\/Bob_Menendez\">Robert Menendez<\/a> (D-N.J.) and wealthy eye doctor <a href=\"http:\/\/edition.cnn.com\/2017\/09\/05\/politics\/who-is-salomon-melgen\/index.html\">Salomon Melgen<\/a>, also on trial Wednesday, have both denied the allegations.<\/strong><\/p>\n<p>It&#8217;s a classic corruption case with a modern political twist: If Menendez is found guilty and subsequently steps down from his position, New Jersey Gov. <a href=\"https:\/\/en.wikipedia.org\/wiki\/Chris_Christie\">Chris Christie<\/a> (R) could name a Republican in his place. And in a divided Senate, one extra Republican vote\u00a0<a href=\"https:\/\/www.washingtonpost.com\/powerpost\/in-the-year-of-the-deciding-vote-one-democrats-corruption-trial-could-change-the-senate--or-not\/2017\/08\/24\/d416ec2c-88e4-11e7-a94f-3139abce39f5_story.html\">could make a world of difference for President Trump&#8217;s agenda<\/a>. <a href=\"https:\/\/en.wikipedia.org\/wiki\/Patient_Protection_and_Affordable_Care_Act\">Obamacare<\/a> would probably have been repealed in July if Senate Republicans had an extra vote.<\/p>\n<p>\u201cThe politics of it are fascinating, and they are fascinating from start to finish,\u201d said <a href=\"https:\/\/www.montclair.edu\/profilepages\/view_profile.php?username=harrisonb\">Brigid Harrison<\/a>, a political science professor at <a href=\"http:\/\/www.montclair.edu\/\">Montclair State University<\/a>.<\/p>\n<p>Here&#8217;s a timeline of the major events in the case, and how a guilty verdict could reverberate in Washington.<\/p>\n<p><strong>2006:<\/strong>\u00a0Menendez is elected to the Senate.<\/p>\n<p><strong>As soon as 2006<\/strong>: Menendez takes weekend and week-long vacations to the Dominican Republic, Florida and Paris with Melgen, on the doctor&#8217;s private jet, prosecutors would later allege.<\/p>\n<p><strong>2012<\/strong>: Menendez gets reelected. Melgen is a major donor, contributing some $600,000 to super <a href=\"https:\/\/en.wikipedia.org\/wiki\/Political_action_committee\">PACS<\/a> to help his reelection campaign.<\/p>\n<p><strong>2012<\/strong>: An anonymous tipster reaches out to media outlets and the FBI to claim Menendez was paying for underage prostitutes while in the Dominican Republic. Those allegations didn&#8217;t pan out, but they spurred the government&#8217;s closer look at Menendez&#8217;s relationship with Melgen,\u00a0<a href=\"https:\/\/www.washingtonpost.com\/politics\/menendez-expected-to-be-indicted-as-soon-as-wednesday-sources-say\/2015\/04\/01\/623024c6-d86e-11e4-8103-fa84725dbf9d_story.html\">The Post&#8217;s Paul Kane and Carol Leonnig<\/a>\u00a0reported.<\/p>\n<p><strong>April 1, 2015<\/strong>: Menendez is indicted on federal corruption charges. It is the first time in a generation that a sitting U.S. senator is indicted by the administration of his own party.<\/p>\n<p>The Justice Department\u00a0accuses Menendez of using his official position to help Melgen get around U.S. government roadblocks for his business and personal ventures. Melgen is also indicted.<\/p>\n<p>The indictment alleges the men\u00a0engaged in a quid pro quo since Menendez was first elected, detailing:<\/p>\n<ul>\n<li>Menendez took\u00a019 free rides on Melgen&#8217;s private jets to luxury resorts around the world, sometimes bringing\u00a0guests.<\/li>\n<li>Menendez helped three of Melgen&#8217;s foreign-born girlfriends get visas to visit the United States.<\/li>\n<li>Over a period of four years, Menendez held several meetings with U.S. health officials to help Melgen settle an $8.9 million Medicare payment dispute, at one point asking\u00a0then-Senate majority leader <a href=\"https:\/\/en.wikipedia.org\/wiki\/Harry_Reid\">Harry M. Reid<\/a> (D-Nev.) to help out.<\/li>\n<li>Melgen made more than $600,000 in campaign donations to super PACs to get Menendez reelected in 2012.<\/li>\n<li>As Melgen was emailing Menendez&#8217;s staff in April and May 2012, promising to donate to Menendez&#8217;s campaign, prosecutors allege Menendez reached out to top State Department officials to urge them to enforce a port-security contract with the Dominican Republic that would benefit Melgen&#8217;s company.<\/li>\n<\/ul>\n<p>Both men deny the charges. Menendez has explained\u00a0that he and Melgen are old friends; they&#8217;ve attended children&#8217;s weddings and given each other birthday gifts, and they&#8217;ve vacationed together. He said he was treating Melgen like any other constituent in need.<\/p>\n<p>\u201cI\u2019m angry and ready to fight,\u201d Menendez tells his supporters the night of the indictment.<\/p>\n<p><strong>April 2015:<\/strong>\u00a0After initially refusing, Menendez temporarily steps down from his position as the top-ranking Democrat on the foreign relations committee as he fights the charges.<\/p>\n<p>His supporters immediately zero in on the benefit Menendez&#8217;s resignation could have for Obama: As a Cuban-American, Menendez vociferously opposed Obama&#8217;s olive branch to Cuba.<\/p>\n<p>There&#8217;s no proof the indictment was in any way connected to politics. But its effect was tangible in the political world nonetheless: \u201cThe net result of the indictment was &#8230; that a legislative check was removed from the Obama administration&#8217;s foreign policy,\u201d Harrison said. \u201cIt raises the frightening idea about the politicization of the Department of Justice.\u201d<\/p>\n<p>In the days before the trial, Obama-era officials are defending the indictment. <a href=\"https:\/\/twitter.com\/waltshaub\/status\/903064470620164097?ref_src=twsrc%5Etfw&amp;ref_url=https%3A%2F%2Fwww.washingtonpost.com%2Fnews%2Fthe-fix%2Fwp%2F2017%2F09%2F05%2Feverything-you-need-to-know-about-sen-bob-menendezs-corruption-trial%2F\">Here<\/a>&#8216;s Obama&#8217;s ethics chief, on Thursday.<\/p>\n<p><strong>June 2016<\/strong>: The Supreme Court\u00a0<a href=\"https:\/\/www.washingtonpost.com\/politics\/supreme-court-rules-unanimously-in-favor-of-former-va-robert-f-mcdonnell-in-corruption-case\/2016\/06\/27\/38526a94-3c75-11e6-a66f-aa6c1883b6b1_story.html\">unanimously overturns\u00a0a public corruption conviction<\/a>\u00a0of former Virginia governor <a href=\"https:\/\/en.wikipedia.org\/wiki\/Bob_McDonnell\">Robert F. McDonnell<\/a>. McDonnell and his wife, <a href=\"http:\/\/heavy.com\/news\/2016\/09\/maureen-mcdonnell-wife-gov-bob-robert-virginia-corruption-justice-department-scandal-charges-dropped-family\/\">Maureen<\/a>, were convicted in 2014 for accepting luxury gifts and cash from a businessman in exchange for McDonnell using the office of\u00a0governor\u00a0to help the businessman.<\/p>\n<p>The justices took issue with what constitutes an \u201cofficial act,\u201d arguing in McDonnell&#8217;s case, it was overly broad.<\/p>\n<p>Menendez&#8217;s lawyers perk\u00a0up at this. The senator\u00a0is accused of trying to influence executive decisions, not of writing laws that helped his buddy,\u00a0they plan to argue, and they will ask the judge to throw the charges out altogether.<\/p>\n<p>\u201cThere is a very real chance this case might be dismissed,\u201d as soon as it gets started,\u00a0Harrison said.<\/p>\n<p><strong>April 2017<\/strong>: In a separate criminal case, a Florida jury\u00a0<a href=\"http:\/\/www.mypalmbeachpost.com\/news\/crime--law\/eye-doc-melgen-guilty-one-nation-biggest-medicare-fraud-cases\/gJHQAY0FO39DSrKXoMtUfM\/\">finds Melgen guilty<\/a>\u00a0of stealing up to $105 million from\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Medicare_(United_States)\">Medicare<\/a> by falsely reporting how much he treated patients in his <a href=\"https:\/\/en.wikipedia.org\/wiki\/Palm_Beach_County,_Florida\">Palm Beach County<\/a> practice. It&#8217;s one of the largest Medicare health-care fraud schemes in history. He could face 20 years in prison when he&#8217;s sentenced this fall.<\/p>\n<p>Those are all the key events leading up to the trial. Here&#8217;s what could happen afterward:<\/p>\n<p><strong>November 2017<\/strong>: Roughly the time the trial is expected to finish.\u00a0This is also when New Jersey will vote for a new governor and its entire\u00a0legislature is up for reelection. Democrats control both chambers and are looking to use Christie&#8217;s historic unpopularity (15 percent approval rating) to gain total control of the state.<\/p>\n<p><strong>Jan. 16, 2018<\/strong>: Christie&#8217;s last day in office. This date is important if Menendez is convicted\u00a0and<em>\u00a0<\/em>if Menendez resigns\u00a0or the Senate votes to kick him out.<\/p>\n<p>The governor can choose who temporarily replaces Menendez until an election is held.<\/p>\n<p>Christie would likely choose a Republican to replace a Democrat, giving Senate Republicans 53 votes, which is a magic number. If they had 53 votes in July, the Obamacare repeal bill that failed by one vote would have likely passed the Senate. If they had 53 votes in February, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Mike_Pence\">Vice President Pence<\/a> wouldn&#8217;t have had to come down to break a tie vote for <a href=\"https:\/\/en.wikipedia.org\/wiki\/Betsy_DeVos\">Education Secretary Betsy DeVos<\/a>.<\/p>\n<p>In short, one extra vote in the Senate matters. A lot.<\/p>\n<p><strong>Unknown date<\/strong>: IF Menendez is convicted, and IF he refuses to resign, would the Senate vote to kick Menendez out? That would require two-thirds of the Senate, or 67 out of 100 senators. That means at least 15 Democrats would have to join all Republicans. Harrison is doubtful, given how much goodwill Menendez has built up \u2014\u00a0and how one vote\u00a0can hold the line for Democrats these days.<\/p>\n<p><strong>November 2018<\/strong>: Menendez&#8217;s seat is up for grabs.\u00a0Especially if\u00a0Menendez is found not guilty, \u201cthe expectation is he would run again and win,\u201d Harrison said. It certainly wouldn&#8217;t be the first time New Jersey voters voted for a politician accused of corruption.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This material belongs to: The Washington Post.
