A federal appeals panel on Tuesday overturned the 2015 corruption convictions of\u00a0Dean G. Skelos<\/a>, once the powerful majority leader of the New York State Senate<\/a>, and his son, Adam B. Skelos<\/a>, toppling the final bookend of what had been historic, back-to-back convictions of two of Albany\u2019s most entrenched leaders.<\/strong><\/p>\n

In ruling in favor of the Skeloses, the judges \u2014 just as another appellate panel\u00a0did in July<\/a>\u00a0for\u00a0Sheldon Silver<\/a>, the former longtime Democratic speaker of the State Assembly<\/a> \u2014 cited a\u00a0decision last year<\/a>\u00a0of the United States Supreme Court<\/a> that narrowed the legal definition of corruption in a case that involved Bob McDonnell<\/a>, the former Republican governor of Virginia.<\/strong><\/p>\n

The convictions of Mr. Skelos and Mr. Silver had heralded a deathblow to the culture of corruption in Albany, sending a signal that no politician in New York was immune from the scrutiny of Preet Bharara<\/a>, then the United States attorney in Manhattan.<\/p>\n

But in the McDonnell opinion, the Supreme Court made it harder for prosecutors to prove corruption. The court ruled that only formal and concrete government actions or decisions could serve as a basis of a corruption prosecution, and not political courtesies like setting up a meeting.<\/p>\n

The McDonnell ruling has had a\u00a0broad ripple effect<\/a>, with defense lawyers raising it in other corruption cases.<\/p>\n

In the Skeloses\u2019 case, the panel found that the judge\u2019s explanation to the jury of an official action was too broad, and that the jury may have convicted the Skeloses for conduct that, under the McDonnell ruling, was not unlawful.<\/p>\n

\u201cBecause we cannot conclude that the instructional error as to \u2018official acts\u2019 was harmless beyond a reasonable doubt,\u201d the panel said, \u201cwe are obliged to vacate defendants\u2019 convictions in their entirety and to remand the case for a new trial.\u201d<\/p>\n

The ruling capped a remarkable recent turn of fortune in New York\u2019s power circles: Mr. Bharara was fired by the Trump administration<\/a> in March; Mr. Silver\u2019s conviction was overturned this summer; and now the Skelos verdicts have been set aside.<\/p>\n

But the appellate panel on Tuesday made it clear that the government\u2019s evidence was still sufficient to allow a properly instructed jury to convict the Skeloses, finding that there was enough evidence to establish that there had been a quid pro quo arrangement in each of the schemes at issue.<\/p>\n

Federal prosecutors said they intended to move quickly to retry Mr. Skelos and his son, just as they have done with Mr. Silver, who is currently scheduled to be retried in April. Mr. Skelos and Mr. Silver both forfeited their seats upon their convictions.<\/p>\n

\u201cWe look forward to a prompt retrial where we will have another opportunity to present the overwhelming evidence of Dean Skelos and Adam Skelos\u2019s guilt and again give the public the justice it deserves,\u201d Joon H. Kim<\/a>, the acting United States attorney in Manhattan, said.<\/p>\n

Mr. Bharara said on Twitter on Tuesday that the ruling was not unexpected but was still disappointing. The Supreme Court \u201cmade it harder to punish corruption, but justice should prevail here,\u201d Mr. Bharara wrote.<\/p>\n
