A Serbian court ruled that ten hectares of land illegally acquired by Belgrade<\/a>\u2019s mayor and his father 12 years ago must be returned to the state,\u00a0KRIK<\/a>\u00a0reported Monday. The ruling is not final and may be appealed.<\/strong><\/p>\n

The affair came to light two years ago when the Crime and Corruption Reporting Network<\/a> (KRIK) and OCCRP<\/a>, reported that the state land was used by Alfa Protein<\/a> \u2013 a company formerly owned by the state but privatized by it\u2019s director Srdjan Gajic<\/a> in 2003 was given to Mali<\/a>.<\/p>\n

Mali was director of the tender department at the state Privatization Agency<\/a> at the time Gajic privatized the company.<\/p>\n

Two years later, Gajic sold the land he never owned to Compost Group<\/a>, part of a holding company majority-owned by Sinisa Mali<\/a>\u2019s father, Borislav Mali<\/a>. It was never paid for.<\/p>\n

Mali later took over his fathers\u2019 holding company and sold it for 500,000 euro to Alessio Investment<\/a>, an offshore in the British Virgin Islands<\/a> he was director of.<\/p>\n

The company listed its representative office at the same address as Mali\u2019s apartment in Belgrade, and his wife as the representative.<\/p>\n

However, the land was still registered as being owned by Compost Group which produced compost \u2013 organic matter used to grow mushrooms.<\/p>\n

Gajic was in 2015 sentenced to two years on probation for illegally giving away the land he never owned but authorities never investigated mayor Sinisa Mali as the buyer.<\/p>\n

In May 2017, a court in Pancevo<\/a> ruled the contract by which Gajic sold the land was invalid and that the land be returned to the state. The ruling is not final and may be appealed.<\/p>\n

The controversial mayor continues to enjoy support from Serbia\u2019s Prime Minister Aleksandar Vucic<\/a> despite numerous affairs he is allegedly involved in.<\/p>\n

Another KRIK and OCCRP investigation found that, while holding various positions within the Privatization agency, Mali\u00a0helped his father privatize \u201cBratstvo\u201d,<\/a>\u00a0a formerly state-owned railroads parts company.<\/p>\n

The journalists also found the mayor concealed that he\u00a0bought 24 apartments<\/a>\u00a0at the Bulgarian seaside in 2012 and 2013 as legal representative of two offshores based in the British Virgin Islands.<\/p>\n

Mali\u2019s ex wife told KRIK<\/a>\u00a0her former husband organized the illegal destruction of private property in Savamala<\/a>, a Belgrade neighborhood that was ravaged with heavy machinery in the middle of the night in April last year.<\/p>\n

The neighborhood allegedly stood in the way of the Belgrade Waterfront<\/a>, a construction project supported by the mayor.<\/p>\n

Prime Minister Vucic said in May that Mali will not be Belgrade\u2019s mayor in the future because the campaign launched against him makes his rerun impossible.<\/p>\n

Last week, however, Vucic changed his mind.<\/p>\n

\u201cI regret that I ever said Sinisa Mali will not be our candidate for mayor of Belgrade\u201d, Vucic said, explaining he said that \u201cunder heavy pressure which I could not endure\u201d.<\/p>\n

The Mayor\u2019s Free Land<\/h3>\n

A company controlled by Mayor of Belgrade Sinisa Mali and his family obtained more than 10 hectares of agricultural land worth anywhere from \u20ac123,000 to \u20ac 250,000 (US$140,000 to US$290,000) for free from a privatized state company.<\/strong><\/p>\n

Problem is, the land wasn\u2019t the company\u2019s to give, but was still owned by the state, making the transfer illegal. Yet the Mali family kept the land for at least 8 years despite multiple prosecutions of people related to the case. It is unclear whether they are connected to the land\u2019s current owner, who could not be located for comment.<\/p>\n

The company in question, Alfa Protein, was privatized starting in 2002 when Mali was an official at the state Agency for Privatization.<\/p>\n

The land sits at the edge of the town of Vrsac<\/a> in Vojvodina<\/a> in Serbia\u2019s northeast, near the Romanian border.<\/p>\n

Alfa Protein was privatized by its director, Sr\u0111an Gaji\u0107<\/a>, after he bought it at a state auction. At that time Mali worked for the Agency for Privatization as the director of the Center for Tenders, which dealt with larger companies. The privatization did not include the 10 hectares of prime agricultural land in question; it had long been used by the company but was not owned by it.<\/p>\n

However, in 2005, Gaji\u0107 allegedly sold the land to a private company, even though he had no legal right to do so. The \u201cbuyer\u201d was the Compost Group, part of a holding company named Ferdi Genetics that was majority-owned by Sinisa Mali\u2019s father, Borislav Mali.<\/p>\n

A purchase agreement says the land was sold for \u20ac 12,000 (US$ 16,000). However, court and company records indicate no money was ever actually paid for the land.<\/p>\n

In 2009, Alfa Protein went bankrupt. Workers complained that the company, once a successful grower of alfalfa, had been gutted by Gaji\u0107 through deals with other companies in which he held an interest. A local prosecutor charged him for abusing his authority by illegally transferring the 10 hectares of land to the Compost Group.<\/p>\n

As Alfa Protein was filing for bankruptcy, Ferdi Genetics<\/a> was being transferred by Borislav Mali to his son Sinisa at no cost. A few days later, Sinisa Mali sold Ferdi Genetics to an offshore company called Alessio Investment from the British Virgin Islands (BVI) for \u20ac 525,000 (US$ 772,000).<\/p>\n

It was a deal in name only. Reporters for KRIK and the Organized Crime and Corruption Reporting Project (OCCRP) discovered that the director of Alessio Investment is, in fact, Sinisa Mali. Alessio Investment listed its representative office at the same address as Mali\u2019s apartment in Belgrade, and his wife as the representative. It is not clear why Mali would charge himself half a million euros for his own company, or whether the payment was ever made. Similar types of transactions often involve money laundering or tax evasion.<\/p>\n

In late 2012, Mali became one of the most influential persons in Serbia, when Aleksandar Vucic\u2019s Serbian Progressive Party<\/a> (SNS) formed a government. In January of 2013, he became Vucic\u2019s economic advisor, specializing in deals with the United Arab Emirates. In April 2014, he was appointed Mayor of Belgrade by Vucic\u2019s government.<\/p>\n

Mali\u2019s role in the Alfa Protein transactions remained unknown as Gaji\u0107, the man who sold the land, was sentenced in 2015 to two year\u2019s probation. The land is still controlled by the Compost Group and the state never ordered the property to be returned. It is being used to produce compost, organic matter used to grow mushrooms.<\/p>\n

Documents reveal other Mali family connections, however. His brother, Predrag Mali<\/a>, served as director of Ferdi Genetics from its founding in 2004 and as director of the Compost Group from 2007. OCCRP\/KRIK reporters obtained bank documents showing that Predrag Mali gave the Compost Group at least \u20ac 250,000 (US$ 330,000) in cash.<\/p>\n

When Gaji\u0107 was on trial, Predrag Mali was one of the witnesses in the case.<\/p>\n

\n

\"OLYMPUS<\/a><\/p>\n

The stand of Compost Group<\/p>\n<\/div>\n

On Feb. 9, 2012, Predrag Mali testified that he was not involved in the deal, since at that time he was not director or in the ownership of the Compost Group, noting that Ferdi Genetics was \u201ca company whose sole owner is my brother, Sinisa Mali.\u201d<\/p>\n

Pedrag Mali also testified that the Compost Group, after it claimed to become the owner of the land in 2005, promptly used the land as collateral for a loan. The state-owned Komercijalna Banka<\/a> estimated the value of the land to 10 million dinars (\u20ac 123,000 or US$ 158,500). The money was used to build an additional structure on the land.<\/p>\n

Dismantling the company<\/strong><\/h3>\n

The former state company Alfa Protein went bankrupt in 2009.<\/p>\n

The former long-time director of Alfa Protein, Lazar Mazmanidis<\/a>, told OCCRP\/KRIK that the company had once been a successful alfalfa producer which grew more than it could export and sell.<\/p>\n

He said he had hired Gaji\u0107 temporarily as a favor to an acquaintance so he could gain job experience, but came to regret it as Gaji\u0107 was not the best worker. \u201cHis policy was to talk, not to work.\u201d<\/p>\n

Mazmanidis said that after he resigned in 2001, Gaji\u0107 was appointed director of Alfa Protein and new problems began. Workers complained that Gaji\u0107 avoided calling assembly meetings where the workers, many of whom were minority shareholders, could express their opinions. They said he didn\u2019t care what union members thought.<\/p>\n

Alfa Protein had already been struggling financially since at least 2000 when it flirted with bankruptcy. Then, in 2003, it was auctioned off by the state and Gaji\u0107, together with two other workers, bought it for less than \u20ac 18,000 (US$ 19,900). Mali was an official at the time in the state Agency for Privatization.<\/p>\n

Two years after the purchase, Gaji\u0107 allegedly illegally transferred the land to the Compost Group and then, in 2009, Alfa Protein went bankrupt. Today, the company is in process of shutting down.<\/p>\n

A workers\u2019 union called for an investigation into Gaji\u0107\u2019s activities, and two were eventually launched in 2007 and 2011 by the state prosecutor in Zrenjanin<\/a> and a prosecutor from Vrsac.<\/p>\n

In the first case, prosecutors said the land was state-owned and Compost and Alfa Protein acted illegally by buying and selling it. They asked the court in Vrsac to return the land to the state but the court never acted.<\/p>\n

Instead, the second case started by the prosecutor in Vrsac looked only at Gajic and left out the politically connected Compost owned by Mali. In that case, the court did not consider the fact that the land was state-owned but rather only that Gaji\u0107 failed to deposit the proceeds from the sale into the Alfa Protein bank accounts and thus harmed the company. The court concluded that no money had been paid and that he \u201cgrossly violated\u201d his power in disposing of the property and he hurt the company.<\/p>\n

At the trial Gaji\u0107 did not present a defense. After a long court procedure, he was sentenced in May 2014 to a year\u2019s probation. Gaji\u0107 appealed, but the verdict was upheld in February 2015.<\/p>\n

Gaji\u0107 was also, in a separate 2008 case, charged for violation of tax laws, OCCRP\/KRIK discovered. In that case he was sentenced to three months\u2019 probation and a fine.<\/p>\n

However, despite all these processes, Mali\u2019s Compost Group kept the land. There is no court process ongoing to recover the state land from the company, which no longer officially belongs to the Mali family. Before taking the mayor\u2019s position, Sinisa Mali transferred the ownership of Ferdi Genetics to a man named Ivica \u0110oli\u0107<\/a> in mid-2013. Reporters from KRIK and OCCRP could not locate \u0110oli\u0107.
