In Newark, New Jersey, a judge declared a mistrial in the case of Senator <a href=\"https:\/\/en.wikipedia.org\/wiki\/Bob_Menendez\">Bob Menendez<\/a>, the Democrat who was accused of taking gifts from a donor in exchange for government favors. The jury was deadlocked, though one member said 10 of the 12 jurors were in favor of acquittal.<\/p>\n<p>Meanwhile, a short train ride away in Manhattan, another federal judge declared another mistrial, this time in the case of <a href=\"https:\/\/nypost.com\/tag\/norman-seabrook\/\">Norman Seabrook<\/a>, a former New York City correction officers\u2019 union chief who was on trial for funneling members\u2019 pension funds into a high-risk investment scheme in exchange for kickbacks.\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/11\/16\/nyregion\/mistrial-is-declared-in-corruption-trial-of-ex-jail-officers-union-chief.html\" data-omni-click=\"r'article',r'link',r'0',r'546143'\">That jury also deadlocked<\/a>.<\/p>\n<p>Even if neither Menendez nor Seabrook broke the law, neither situation feels good. Menendez and <a href=\"http:\/\/edition.cnn.com\/2017\/09\/05\/politics\/who-is-salomon-melgen\/index.html\">Salomon Melgen<\/a> were\u00a0<a href=\"http:\/\/www.nj.com\/politics\/index.ssf\/2017\/10\/menendez_defense_begins.html\" data-omni-click=\"r'article',r'link',r'1',r'546143'\">good friends<\/a>; Melgen paid for private jet flights and vacations for Menendez; and Menendez intervened on Melgen\u2019s behalf in government,\u00a0<a href=\"http:\/\/www.nj.com\/politics\/index.ssf\/2017\/09\/menendez_trial_1.html\" data-omni-click=\"r'article',r'link',r'2',r'546143'\">for example by calling diplomats to try to help Melgen\u2019s girlfriends get visas to the United States<\/a>. The question was whether these were illegal official favors bought and paid for by Melgen\u2019s gifts, or were simply favors.<\/p>\n<p>Seabrook, meanwhile, was accused of taking a cut in exchange for sending pension funds to a high-risk investment fund. Jurors couldn\u2019t decide, but Seabrook\u2019s high-rolling lifestyle, on a\u00a0<a href=\"https:\/\/www.nytimes.com\/2016\/06\/09\/nyregion\/norman-seabrook-jail-officers-union-arrest.html\" data-omni-click=\"r'article',r'link',r'3',r'546143'\">$300,000 salary<\/a>, and his role as\u00a0<a href=\"https:\/\/www.nytimes.com\/2014\/12\/15\/nyregion\/at-rikers-a-roadblock-to-reform.html\" data-omni-click=\"r'article',r'link',r'4',r'546143'\">a crucial impediment to reform\u00a0<\/a>at New York\u2019s deeply troubled <a href=\"https:\/\/en.wikipedia.org\/wiki\/Rikers_Island\">Rikers Island<\/a> prison, didn\u2019t require court adjudication.<\/p>\n<p id=\"article-section-2\">Prosecutors say they will try Seabrook again; it\u2019s unclear whether Menendez will face another trial, though the 10-2 deadlock can\u2019t be encouraging to the government. Meanwhile, Senate Majority Leader <a href=\"https:\/\/en.wikipedia.org\/wiki\/Mitch_McConnell\">Mitch McConnell<\/a> on Thursday called for a <a href=\"https:\/\/www.ethics.senate.gov\/public\/\">Senate Ethics Committee<\/a> probe of Menendez. \u201cSenator Menendez was indicted on numerous federal felonies,\u201d McConnell said in a statement. \u201cHe is one of only twelve U.S. senators to have been indicted in our history.\u201dIf both men go free, however, they will be the latest examples in an emerging trend: People around the world, and Americans in particular, seem to be living through a golden age of corruption.One could date the trend inside the U.S. to June 2016, when the Supreme Court overturned the corruption conviction of former Virginia Governor <a href=\"https:\/\/en.wikipedia.org\/wiki\/Bob_McDonnell\">Bob McDonnell<\/a>. It\u2019s not that the justices found that McDonnell hadn\u2019t done the things for which he was convicted; it\u2019s that they decided that his favors on behalf of a friend who gave him more than $175,000 in gifts didn\u2019t constitute legal corruption.\u00a0<a href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2017\/10\/menendez-mcdonnell-supreme-court\/543354\/\" data-omni-click=\"r'article',r'link',r'5',r'546143'\">As my colleague Matt Ford explained<\/a>, the\u00a0McDonnell<em>\u00a0<\/em>decision played a key role in the Menendez case, with the judge nearly throwing the whole case out because of the Supreme Court\u2019s verdict.Since then, prosecutors have been stymied over and over. As U.S. attorney in Manhattan, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Preet_Bharara\">Preet Bharara<\/a> made his name racking up corruption convictions for major New York state politicians, including <a href=\"https:\/\/en.wikipedia.org\/wiki\/Sheldon_Silver\">Sheldon Silver<\/a>, the Democratic speaker of the New York State Assembly, and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Dean_Skelos\">Dean Skelos<\/a>, his Republican counterpart in the State Senate. In March, President <a href=\"https:\/\/en.wikipedia.org\/wiki\/Donald_Trump\">Trump<\/a> fired Bharara, despite having previously told him he would stay on. In July,\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/07\/13\/nyregion\/sheldon-silvers-conviction-is-overturned.html\" data-omni-click=\"r'article',r'link',r'6',r'546143'\">Silver\u2019s conviction was overturned<\/a>, and two months later,\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/09\/26\/nyregion\/dean-skelos-2015-corruption-conviction-overturned.html\" data-omni-click=\"r'article',r'link',r'7',r'546143'\">so was Skelos\u2019s<\/a>.<\/p>\n<section id=\"article-section-3\">The moment is not restrained to the U.S.\u2014it is international, or perhaps more rightly transnational. Earlier this month, the <a href=\"https:\/\/en.wikipedia.org\/wiki\/International_Consortium_of_Investigative_Journalists\">International Consortium of Investigative Journalists<\/a> revealed a tranche of documents\u00a0<a href=\"https:\/\/www.icij.org\/investigations\/paradise-papers\/\" data-omni-click=\"r'article',r'link',r'8',r'546143'\">they called the Paradise Papers<\/a>, a follow-up to the blockbuster 2015 <a href=\"https:\/\/en.wikipedia.org\/wiki\/Panama_Papers\">Panama Papers<\/a>. But in comparison, the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Paradise_Papers\">Paradise Papers<\/a> seemed to land with much less impact. That\u2019s not because the behavior described in the Paradise Papers is necessarily less egregious; perhaps the problem is that the public is so news-saturated that fatigue prevented greater focus.The documents implicated\u00a0<a href=\"https:\/\/www.theguardian.com\/news\/2017\/nov\/05\/revealed-queen-private-estate-invested-offshore-paradise-papers\" data-omni-click=\"r'article',r'link',r'9',r'546143'\">Queen Elizabeth II<\/a>\u00a0in dubious investments in the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Cayman_Islands\">Cayman Islands<\/a>, a notorious tax shelter. Apple, having remonstrated that it was not hiding its cash \u201con some Caribbean island,\u201d\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/11\/06\/world\/apple-taxes-jersey.html?rref=collection%2Fbyline%2Fjesse-drucker\" data-omni-click=\"r'article',r'link',r'10',r'546143'\">devised a scheme<\/a>\u00a0to hide its cash on Jersey, an island in the <a href=\"https:\/\/en.wikipedia.org\/wiki\/English_Channel\">English Channel<\/a>, instead.<a href=\"https:\/\/en.wikipedia.org\/wiki\/Wilbur_Ross\">Wilbur Ross<\/a>, the secretary of commerce, came out looking especially bad. When he entered the Trump administration, Ross\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/11\/05\/world\/wilbur-ross-russia.html\" data-omni-click=\"r'article',r'link',r'11',r'546143'\">kept an investment<\/a>\u00a0in a shipping company with close ties to the Kremlin and a <a href=\"https:\/\/en.wikipedia.org\/wiki\/Vladimir_Putin\">Vladimir Putin<\/a> crony facing sanctions. He disclosed the existence of the investment partnership during the confirmation process, but not that the partnership was invested in the shipping company.\u00a0Forbes, which had long featured Ross on its list of the richest people,\u00a0<a href=\"https:\/\/www.forbes.com\/sites\/danalexander\/2017\/11\/07\/the-case-of-wilbur-ross-phantom-2-billion\/\" data-omni-click=\"r'article',r'link',r'12',r'546143'\">announced<\/a>\u00a0that having reviewed new documents it no longer believed he was even a billionaire.<\/p>\n<p>Of course, there\u2019s corruption around the world.\u00a0The New York Times<em>\u00a0<\/em>has published a series of articles on how Vladimir Putin has enriched himself and his friends as Russian president. The cartoonishly gauche former Italian Prime Minister <a href=\"https:\/\/en.wikipedia.org\/wiki\/Silvio_Berlusconi\">Silvio Berlusconi<\/a> on Thursday\u00a0<a href=\"http:\/\/www.reuters.com\/article\/us-italy-berlusconi-divorce\/italys-berlusconi-wins-alimony-case-ex-wife-told-to-pay-back-millions-idUSKBN1DG2D9?il=0\" data-omni-click=\"r'article',r'link',r'13',r'546143'\">won a judgment against his ex-wife<\/a>, with a court ruling a divorce settlement had been too generous to her.What accounts for this boom time in the corruption industry? It isn\u2019t necessarily that the world is more corrupt than it has been; wherever there\u2019s a buck, or pound, or dirham, or ruble to be made, someone\u2019s going to try to make it. Nonetheless, it feels like the bad actors are getting away with it more at this moment.<\/p>\n<p>Legal precedents like the\u00a0McDonnell\u00a0case are one part of the equation. So are ever looser campaign-finance laws, which allow larger infusions of money from individuals and groups, and make it easier to shroud the source of that money. As the Paradise Papers show, the globalized, digital world and\u00a0<a href=\"https:\/\/www.theatlantic.com\/business\/archive\/2017\/11\/paradise-papers-panama-taxes\/545198\/\" data-omni-click=\"r'article',r'link',r'14',r'546143'\">an arms race of clever tax-sheltering strategies<\/a>\u00a0make it easier for the wealthy to find ways to stash their cash in questionable ways, often undetected\u2014until big leaks like the Panama and Paradise papers. And with wealth around the world\u00a0<a href=\"https:\/\/www.theguardian.com\/inequality\/2017\/nov\/14\/worlds-richest-wealth-credit-suisse\" data-omni-click=\"r'article',r'link',r'15',r'546143'\">increasingly concentrated\u00a0<\/a>in the hands of a narrow elite, there\u2019s more demand to shelter it.<\/p>\n<p>There\u2019s one more glaring factor within the United States, though: the president. Without necessarily breaking any laws\u2014he has neither been charged nor convicted of having done so\u2014Donald Trump has set a tone that makes the social environment more friendly to corrupt behavior.It\u2019s not just a matter of\u00a0<a href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2017\/01\/donald-trump-scandals\/474726\/\" data-omni-click=\"r'article',r'link',r'16',r'546143'\">the many scandals that dogged him<\/a>\u00a0as a private citizen. After his election, Trump refused to put his assets into the customary blind trust that officeholders use, instead creating an arrangement that still gave him significant visibility into his assets, and which most ethics experts dismissed as wholly inadequate. (Since then, his son <a href=\"https:\/\/en.wikipedia.org\/wiki\/Eric_Trump\">Eric Trump<\/a> has suggested in interviews that his father speaks to him about the <a href=\"https:\/\/en.wikipedia.org\/wiki\/The_Trump_Organization\">Trump Organization<\/a>, despite a pledge of distance.) In several ways, Trump appears to be benefiting financially from his role as president. He has been sued for violating the Constitution\u2019s emoluments clause, and his Trump Hotel has become a hotspot for GOP fundraising and a destination for foreign diplomats eager to curry favor with the government.<\/p>\n<p>Trump\u2019s son-in-law and senior adviser <a href=\"https:\/\/en.wikipedia.org\/wiki\/Jared_Kushner\">Jared Kushner<\/a> may also have mixed his own business with the public\u2019s. Kushner met with the Russian state-owned <a href=\"https:\/\/en.wikipedia.org\/wiki\/Vnesheconombank\">Vnesheconombank<\/a> (<a href=\"https:\/\/en.wikipedia.org\/wiki\/Vnesheconombank\">VEB<\/a>) in December.\u00a0<a href=\"https:\/\/www.washingtonpost.com\/politics\/explanations-for-kushners-meeting-with-head-of-kremlin-linked-bank-dont-match-up\/2017\/06\/01\/dd1bdbb0-460a-11e7-bcde-624ad94170ab_story.html?utm_term=.13e4fb83d379\" data-omni-click=\"r'article',r'link',r'17',r'546143'\">VEB says<\/a>\u00a0the meeting concerned the Kushner family\u2019s private real-estate business, while Kushner says he attended in an official, diplomatic capacity. Though Kushner left the business, his sister was later found to have been\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/08\/03\/business\/kushner-eb-5-china-green-cards.html\" data-omni-click=\"r'article',r'link',r'18',r'546143'\">using his name in presentations overseas<\/a>.<\/p>\n<p>Trump picked Ross as his commerce secretary, of course. He also appointed fellow New York businessman <a href=\"https:\/\/en.wikipedia.org\/wiki\/Carl_Icahn\">Carl Icahn<\/a> to a nebulous advisory role, which a\u00a0New Yorker<em>\u00a0<\/em>report\u00a0<a href=\"https:\/\/www.newyorker.com\/magazine\/2017\/08\/28\/carl-icahns-failed-raid-on-washington\" data-omni-click=\"r'article',r'link',r'19',r'546143'\">strongly suggested Icahn used to enrich himself<\/a>. (Icahn resigned as the story went to press, and\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/11\/08\/business\/carl-icahn-trump-ethanol-subpoena.html\" data-omni-click=\"r'article',r'link',r'20',r'546143'\">he is now under federal investigation<\/a>.) Late last month, meanwhile, special counsel <a href=\"https:\/\/en.wikipedia.org\/wiki\/Robert_Mueller\">Robert Mueller<\/a> indicted two Trump campaign officials, former campaign chair <a href=\"https:\/\/en.wikipedia.org\/wiki\/Paul_Manafort\">Paul Manafort<\/a> and his aide <a href=\"https:\/\/en.wikipedia.org\/wiki\/Rick_Gates_(political_consultant)\">Rick Gates<\/a>, accusing them of devising a $75 million money-laundering scheme.<\/p>\n<p>There are many reasons why prosecutors are struggling to convict people who they accuse of corruption, and each case has its own unique dynamic.
