{"id":8088,"date":"2018-01-24T15:09:43","date_gmt":"2018-01-24T12:09:43","guid":{"rendered":"http:\/\/anticorr.media\/?p=8088"},"modified":"2018-01-29T11:06:09","modified_gmt":"2018-01-29T08:06:09","slug":"singapur-peresmotrel-antikorrupcionnoe-zakonodatelstvo-na-fone-gromkogo-skandala","status":"publish","type":"post","link":"https:\/\/anticorr.media\/en\/singapur-peresmotrel-antikorrupcionnoe-zakonodatelstvo-na-fone-gromkogo-skandala\/","title":{"rendered":"Scandal-hit Singapore Reviews Anti-Corruption Laws"},"content":{"rendered":"<p>This material belongs to: <a href=\"https:\/\/www.occrp.org\/en\/daily\/7541-scandal-hit-singapore-reviews-anti-corruption-laws\">OCCRP<\/a>.<\/p>\n<p><strong>Singapore\u2019s anti-corruption agency is reviewing the country\u2019s graft laws in the wake of several major fraud scandals.<\/strong><\/p>\n<p dir=\"ltr\"><strong>Legal experts say that the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Public_Prosecutor_v_Taw_Cheng_Kong\">Prevention of Corruption Act 1960 (PCA)<\/a>, Singapore\u2019s primary anti-corruption law, is outdated and neither deters malpractice nor adequately punishes the corporate sector.<\/strong><\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/en.wikipedia.org\/wiki\/Keppel_Corporation\">Keppel Corp<\/a>, whose largest shareholder is state sovereign wealth fund <a href=\"https:\/\/en.wikipedia.org\/wiki\/Temasek_Holdings\">Temasek Holdings<\/a>, has agreed to a US $422 million charge, in a multilateral deal, to resolve investigations by American, Brazilian and Singapore authorities into alleged bribes of Brazilian officials.<\/p>\n<p dir=\"ltr\">Its subsidiary, <a href=\"http:\/\/www.keppelom.com\/en\/\">Keppel O&amp;M<\/a> \u2013 the largest builder of oil rigs in the world \u2013 paid US$55 million in bribes between 2001 and 2014 to win 13 contracts with <a href=\"https:\/\/en.wikipedia.org\/wiki\/Petrobras\">Petrobras<\/a> and <a href=\"http:\/\/ri.setebr.com\/\">Sete Brasil<\/a>, according to court documents the <a href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_Department_of_Justice\">US Justice Department<\/a> released.<\/p>\n<p dir=\"ltr\">The company denied authorizing bribes paid by its Brazilian agent, <a href=\"https:\/\/pt.wikipedia.org\/wiki\/Zwi_Skornicki\">Zwi Skornicki<\/a>. However, it eventually acknowledged that the corrupt payments were \u201cmade with knowledge or approval\u201d of former executives.<\/p>\n<p dir=\"ltr\">The disclosure of the case, coupled with a similar scandal over US $19 million in bribes paid to state-linked shipbuilder <a href=\"https:\/\/www.facebook.com\/pages\/Singapore-Technologies-Marine\/202012889871768\">Singapore Technologies Marine<\/a>, has dented Singapore\u2019s enviable reputation on corruption.<\/p>\n<p dir=\"ltr\">It is ranked seventh-least corrupt nation in the world by the <a href=\"https:\/\/www.transparency.org\/\">Global Anti-Corruption Coalition<\/a>, Transparency International.<\/p>\n<p dir=\"ltr\">\u201cThe Singapore government regularly reviews the provisions in the PCA with a view toward improving the anti-corruption regime in Singapore,\u201d anti-corruption officials said in\u00a0<a href=\"https:\/\/www.reuters.com\/article\/us-singapore-corruption\/singapore-reviewing-anti-graft-law-amid-mounting-calls-to-make-it-tougher-idUSKBN1FC0RJ\" target=\"_blank\" rel=\"noopener\">a statement to Reuters<\/a>\u00a0on Monday. \u201cThe PCA is currently going through a review.\u201d<\/p>\n<p dir=\"ltr\">Legal experts have suggested raising the maximum financial penalty, now set at US $75,800 per offense, that can be levied under the PCA.<\/p>\n<p dir=\"ltr\">\u201cIn today\u2019s context, a penalty of S$100K per charge is on the low side. It may not have been so in 1989 when the penalty was set,\u201d said <a href=\"https:\/\/en.wikipedia.org\/wiki\/Eugene_Tan\">Eugene Tan<\/a>, an associate professor of law at the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Singapore_Management_University\">Singapore Management University<\/a>, in comments reported by <a href=\"https:\/\/en.wikipedia.org\/wiki\/Reuters\">Reuters<\/a>.<\/p>\n<p dir=\"ltr\">Had Keppel been subject to Singaporean law \u2013 as opposed to its liabilities under the multilateral resolution agreed \u2013 the fine it received would have been significantly less than the US $422 million punishment, nearly eight times the value of the alleged bribes, according to <a href=\"https:\/\/en.wikipedia.org\/wiki\/Indranee_Rajah\">Indranee Rajah<\/a>, the law and finance minister.<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/en.wikipedia.org\/wiki\/Pritam_Singh\">Pritam Singh<\/a> of the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Workers%27_Party_(Singapore)\">Workers\u2019 Party<\/a>, Singapore\u2019s only opposition party in parliament, told <a href=\"https:\/\/en.wikipedia.org\/wiki\/Reuters\">Reuters<\/a>: \u201cTougher penalties will have a deterrent effect.\u201d<\/p>\n<p dir=\"ltr\">\u201cGiven the scale and the length of illicit dealings, it raises legitimate questions of corporate governance, board leadership and stewardship,\u201d Tan said, according to<a href=\"http:\/\/www.scmp.com\/week-asia\/politics\/article\/2126198\/oil-bribes-politicians-what-happened-clean-singapore\" target=\"_blank\" rel=\"noopener\">\u00a0the South China Morning Post<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This material belongs to: OCCRP.
