But for the 72-year-old known simply as \u201cLula,\u201d the 3-0 ruling poses potentially career-ending obstacles.\u00a0<\/strong><\/p>\n<p id=\"U12402883632344H0C\">Brazil\u2019s poverty-busting president from 2003 to 2011 has emerged as the early front-runner in this year\u2019s presidential race. He is the left\u2019s best chance against a field of candidates including his closest rival, a far-right firebrand known for misogynistic comments.<b>\u00a0<\/b>But Brazil\u2019s \u201cclean record law\u201d bars politicians with convictions upheld on appeal from running for office.<\/p>\n<p>\u201cThere is proof beyond a reasonable doubt that the ex-president was one of the actors, if not the principal actor, of an ample corruption scheme,\u201d one of the appellate judges, <a href=\"https:\/\/pt.wikipedia.org\/wiki\/Jo%C3%A3o_Pedro_Gebran_Neto\">Jo\u00e3o Pedro Gebran Neto<\/a>, said in the courtroom. He recommended that Lula\u2019s 2017 sentence of 9 1\/2\u00a0 years be extended to more than 12 years, saying that \u201cat a minimum, he was conscious and gave support to what happened.\u201d<\/p>\n<p>A defiant Lula proclaimed his innocence after the ruling and promised to fight on. \u201cNo heads down. Heads high. .\u2009.\u2009. Never give up,\u201d he told supporters in <a href=\"https:\/\/en.wikipedia.org\/wiki\/S%C3%A3o_Paulo\">Sao Paulo<\/a>. \u201cI want to warn the Brazilian elite: Just wait because we will be back,\u201d he added.<\/p>\n<p>\u201cI don\u2019t want anyone to be worried for Lula,\u201d the former president said. \u201cI want us to be worried about what is happening in government.\u201d<\/p>\n<p>Linked to a massive corruption probe known as \u201c<a href=\"https:\/\/www.washingtonpost.com\/news\/worldviews\/wp\/2017\/02\/12\/brazils-huge-corruption-scandal-begins-to-affect-the-rest-of-latin-america\/?utm_term=.aff2569a6f02\" shape=\"rect\">Operation Car Wash<\/a>,\u201d Lula was convicted\u00a0of receiving bribes worth more than $1 million, mostly in the form of a refurbished beachfront apartment. He can still appeal to higher courts. But Wednesday\u2019s outcome suggested a protracted legal battle ahead in which Lula\u2019s eligibility to run might not be fully determined until as late as September \u2014 a month before the\u00a0elections.<\/p>\n<p>Higher courts have been generally upholding convictions linked to <a href=\"https:\/\/de.wikipedia.org\/wiki\/Operation_Lava_Jato\">Car Wash<\/a>, a four-year probe into bribes paid by construction companies to public officials in exchange for lucrative government contracts, many with the state-owned oil company.<\/p>\n<p>But Lula\u2019s <a href=\"https:\/\/en.wikipedia.org\/wiki\/Workers%27_Party_(Brazil)\">Workers\u2019 Party<\/a> has pledged to stick by his candidacy no matter what. His ardent supporters immediately denounced the decision as a politically motivated gambit and burned tires on streets here and in Sao Paulo, Brazil\u2019s largest city.<\/p>\n<p>His backers built a small tent city here ahead of the verdict, complete with makeshift stores and restaurants. Earlier Wednesday, they marched as close as they could get to the courthouse, but huge lines of police officers on horseback held them back. After the decision, and amid a driving rain in <a href=\"https:\/\/en.wikipedia.org\/wiki\/Porto_Alegre\">Porto Alegre<\/a>, dejected supporters packed buses en route to their homes.<\/p>\n<p>\u201cI\u2019m frustrated and sad, but the fight is much bigger than this,\u201d said Ronaldo Soares, 41, a trainee chef who traveled 3\u00bd \u00a0 days by bus to rally for Lula. \u201cA new dictatorship is starting in Brazil. It\u2019s a class fight. The rich and elite, the market forces, big business is in charge of everything. This is a big step back for the workers, but we need to step up and fight for Lula because he represents democracy.\u201d<\/p>\n<p>Demonstrators against Lula, meanwhile, celebrated in the streets, hailing the verdict as a sign that the rule of law was being upheld.<\/p>\n<p>\u201cAll the mechanisms to guarantee impunity in public officials were put in place to try and protect Lula,\u201d said Iria Cabrera, organizer of an anti-Lula\u00a0demonstration in Porto Alegre. \u201cAnd if this person can see justice, you open a path to have people pay for their crimes, any person on any level.\u201d<\/p>\n<p>Lula\u2019s 2017 conviction stems from allegations he accepted the remodeled beachfront pad in a middle-class resort from a construction firm in return for public contracts.\u00a0Wednesday\u2019s unanimous decision leaves Lula with two remaining appeals, including to\u00a0Brazil\u2019s supreme court.\u00a0However, Lula can also apply to an electoral tribunal for a special exemption to run for president despite the conviction\u00a0if his appeal drags on.<\/p>\n<p>\u201cOne thing that could play to Lula\u2019s advantage is that political considerations are likely to play an increasingly important role in the process,\u201d said <a href=\"https:\/\/en.wikipedia.org\/wiki\/Peter_Hakim\">Peter Hakim<\/a>, a senior fellow at the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Inter-American_Dialogue\">Inter-American Dialogue<\/a>. \u201cTo be sure, the decisions will, for the most part, be made by mostly honest and competent judges. But, like judges in the U.S., they do have political views that affect their reasoning.\u201d<\/p>\n<p>The decision will shape the 2018 presidential race in a nation exhausted by nonstop political scandals.<\/p>\n<p>In October, Brazilian lawmakers blocked a corruption trial against President <a href=\"https:\/\/en.wikipedia.org\/wiki\/Michel_Temer\">Michel Temer<\/a> after concessions to pro-business political factions. Temer took office in 2016 after\u00a0President <a href=\"https:\/\/en.wikipedia.org\/wiki\/Dilma_Rousseff\">Dilma Rousseff<\/a> was impeached for fiscal abuses. But Temer remains hugely unpopular, with approval ratings as low as 3 percent.<\/p>\n<p>If Lula is unable to\u00a0run, it could present an opening for the right \u2014 including former army officer <a href=\"https:\/\/en.wikipedia.org\/wiki\/Jair_Bolsonaro\">Jair Bolsonaro<\/a>, his leading rival, or Sao Paulo Mayor <a href=\"https:\/\/en.wikipedia.org\/wiki\/Jo%C3%A3o_Doria\">Jo\u00e3o Doria<\/a>, a businessman turned host of Brazil\u2019s version of \u201c<a href=\"https:\/\/en.wikipedia.org\/wiki\/The_Apprentice_(U.S._TV_series)\">The Apprentice<\/a>\u201d who has been widely compared to the show\u2019s former American host,\u00a0President <a href=\"https:\/\/en.wikipedia.org\/wiki\/Donald_Trump\">Trump<\/a>.<\/p>\n<p>Lula\u2019s \u201cbase sees him as a godlike figure,\u201d said <a href=\"http:\/\/trendovina.ru\/videotrend\/yYjqhaLDPG4Q_\/_Heni_Ozi_Cukier_debate_a_crise_dos_refugiados_na_Europa_no_programa_Entre_Aspas_da_Globonews.html\">Heni Ozi Cukier<\/a>, a political scientist at <a href=\"https:\/\/en.wikipedia.org\/wiki\/Escola_Superior_de_Propaganda_e_Marketing\">ESPM University<\/a>, also in Sao Paulo. \u201cIf Lula is in the election, the election becomes about who can beat Lula. Without Lula, it\u2019s a very open playing field.\u201d<\/p>\n<p>The conviction has amounted to a hard fall from grace for a man who once ranked as Brazil\u2019s best-liked president and who was described by\u00a0former U.S. president <a href=\"https:\/\/en.wikipedia.org\/wiki\/Barack_Obama\">Barack Obama<\/a> as \u201cthe most popular politician on Earth.\u201d He was the nation\u2019s first leader from a poor background \u2014 a factory worker who made his way into politics by way of prominent labor unions.<\/p>\n<p>Under his leadership, Brazil\u2019s economy boomed, and 40 million people rose out of poverty as he built an ambitious social safety net called \u201czero hunger.\u201d<\/p>\n<p>Yet Lula is accused of seven other crimes \u2014 including other counts of corruption, influence peddling and illegal campaign financing.<\/p>\n<p>In addition to the beach apartment in the resort of <a href=\"https:\/\/en.wikipedia.org\/wiki\/Guaruj%C3%A1\">Guaruja<\/a>, prosecutors say he received an apartment on the outskirts of Sao Paulo and a $4 million plot of land where his charitable institute is located.<\/p>\n<p>Lula and his allies maintain that the charges are all politically motivated. His defense team says he and his wife, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Marisa_Let%C3%ADcia_Lula_da_Silva\">Marisa<\/a>, never owned the beachfront apartment in question and visited the unit only to consider purchasing it.<\/p>\n<p>\u201cThis process has been marked by gross violations of due process,\u201d one of Lula\u2019s lawyers, <a href=\"https:\/\/twitter.com\/czmartins\">Cristiano Zanin Martins<\/a>, said this week. \u201cThe prosecutors have utilized the press and social networks to try to demonize Lula and try to impede his right to be innocent until proven guilty.\u201d<\/p>\n<p>Yet on Wednesday, the appeals court said witness testimony indicated that the apartment in question had been reserved for Lula and his wife and that renovations on it were made at his request. The court took issue with the defense team\u2019s insistence that the judges were acting as the political puppets of Lula\u2019s right-wing opponents.<\/p>\n<p>\u201cJust like what happened with American President <a href=\"https:\/\/en.wikipedia.org\/wiki\/Richard_Nixon\">Richard Nixon<\/a> in the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Watergate_scandal\">Watergate case<\/a> .\u2009.\u2009. we now see [that] the law is for everyone,\u201d said Justice Leonardo Paulsen.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This material belongs to: The Washington Post.
