{"id":9184,"date":"2018-02-28T15:35:01","date_gmt":"2018-02-28T12:35:01","guid":{"rendered":"http:\/\/anticorr.media\/?p=9184"},"modified":"2018-03-18T16:47:50","modified_gmt":"2018-03-18T13:47:50","slug":"novoe-antikorrupcionnoe-super-ministerstvo-kitaya-vyzvalo-u-pravozashhitnikov-opaseniya","status":"publish","type":"post","link":"https:\/\/anticorr.media\/en\/novoe-antikorrupcionnoe-super-ministerstvo-kitaya-vyzvalo-u-pravozashhitnikov-opaseniya\/","title":{"rendered":"China: New Anti-corruption \u201cSuper Ministry\u201d Raises Rights Concerns"},"content":{"rendered":"<p>This material belongs to: <a href=\"https:\/\/www.occrp.org\/en\/27-ccwatch\/cc-watch-briefs\/7705-china-new-anti-corruption-super-ministry-raises-rights-concerns\">OCCRP<\/a>.<\/p>\n<p><strong>In anticipation of a new anti-corruption \u201csuper ministry,\u201d set to be established next month, Chinese officials explained and defended a controversial new system for detaining corruption suspects,\u00a0<a href=\"https:\/\/www.reuters.com\/article\/us-china-politics-corruption\/china-defends-controversial-detention-measure-of-new-anti-graft-ministry-idUSKCN1GB0KY?il=0\">Reuters<\/a> reported on Tuesday.<\/strong><\/p>\n<p dir=\"ltr\">The new detention system, \u201c<a href=\"https:\/\/en.wikipedia.org\/wiki\/Liuzhi_Special_District\">liuzhi<\/a>,\u201dmakes a few reforms on the old system, where corruption suspects might have been taken to hotel rooms for interrogation at times and in places chosen by prosecutors.<\/p>\n<p dir=\"ltr\">Some human rights groups alleged that this old system allowed torture and forced confessions to run rampant, corrupting China\u2019s own anti-corruption arm.<\/p>\n<p dir=\"ltr\">The new law includes steps to prevent abuses, such as informing family members and employers shortly after a suspect is detained and required video recordings of interrogations, according to the most recent draft.<\/p>\n<p dir=\"ltr\">However, the new detention system still operates outside existing criminal procedure law &#8211; it follows party rules rather than the rules of the Chinese justice system.<\/p>\n<p dir=\"ltr\">President <a href=\"https:\/\/en.wikipedia.org\/wiki\/Xi_Jinping\">Xi Jinping<\/a> first announced the new detention system in the fall of last year, when it also faced scrutiny by legal scholars and human rights activists.<\/p>\n<p dir=\"ltr\">But other recent changes to China\u2019s anti-corruption apparatus are causing concerns among those worried about surveillance and suspect\u2019s rights.<\/p>\n<p dir=\"ltr\">News that <a href=\"https:\/\/en.wikipedia.org\/wiki\/Communist_Party_of_China\">China\u2019s Communist Party<\/a> decided to abolish term limits on the presidency, reported by\u00a0<a href=\"https:\/\/www.nytimes.com\/2018\/02\/25\/world\/asia\/china-xi-jinping.html\">The New York Times<\/a>\u00a0on Saturday, adds further context to a moment in which Xi is working to consolidate power and \u2018clean up\u2019 his administration.<\/p>\n<p dir=\"ltr\">Xi\u2019s new anti-corruption push and the creation of the <a href=\"https:\/\/thediplomat.com\/tag\/national-supervision-commission\/\">National Supervision Commission<\/a> &#8211; the super ministry that will likely be established in March, could also expand state surveillance and arbitrary against Chinese citizens, critics and legal scholars allege.<\/p>\n<p dir=\"ltr\">The <a href=\"https:\/\/thediplomat.com\/tag\/national-supervision-commission\/\">National Supervision Commission<\/a> will have the the power to investigate all state employees as well as managers working for state-backed schools, hospitals, institutes or companies,\u00a0<a href=\"https:\/\/www.reuters.com\/article\/us-china-politics-corruption-analysis\/chinas-new-anti-graft-superministry-adds-to-concerns-about-suspects-rights-idUSKCN1G71AM\">Reuters<\/a>\u00a0reported on Friday.<\/p>\n<p dir=\"ltr\">Provincial-level branches of the commission will be established to increase the number of people who can be prosecuted.<\/p>\n<p dir=\"ltr\"><a href=\"http:\/\/usaweekly.com\/2018\/02\/china-defends-controversial-detention\/head-of-beijing-municipal-supervision-commission-zhang-shuofu-attends-a\/\">Zhang Shuofu<\/a>, a Chinese official who will be helping roll out the new detention system for corruption suspects, defended the changes to China\u2019s system by arguing that corruption crimes are fundamentally different than other crimes.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This material belongs to: OCCRP.
